Abstract: This article examines the role of public health authorities in implementing the principles articulated by the Italian Constitutional Court on medically assisted suicide, in the absence of a comprehensive national statutory framework. After reconstructing the constitutional background of the right to life and therapeutic self-determination, the article analyses the development of constitutional case law starting from Judgment No. 242/2019, with particular reference to Judgments No. 135/2024 and No. 204/2025. The focus is on the procedural nature of the tasks entrusted to the National Health Service and on the constitutional limits of regional regulatory intervention, highlighting the need for national legislation capable of ensuring uniform application and legal certainty.
