La ghigliottina e la tagliola: riflessi di un istituto parlamentare tra ordinamento nazionale e regionale – C. Pecoraro
Il presente lavoro indaga le tecniche di chiusura forzata del dibattito come strumenti di “governo del tempo” parlamentare, mettendo a fuoco un medesimo meccanismo di compressione della dialettica assembleare che, nella prassi, ha assunto denominazioni e configurazioni differenti, in particolare quelle di “ghigliottina” e “tagliola”.
Abstract: This paper analyses techniques for forcibly closing parliamentary debates as tools for managing time, starting from the premise that the temporal dimension is not neutral and that it impacts the balance between the deliberative function and majority decision-making. It examines the relationship between filibustering and anti-filibustering measures, focusing in particular on the most effective ways of curtailing parliamentary debate. The analysis therefore focuses on the so-called ‘guillotine’ in the national Parliament and the so-called ‘tagliola’ in the Sicilian Regional Assembly. Through an in-depth reconstruction of the origins, function and methods of application of both, this paper highlights how they can be traced back to the same procedural mechanism, applied in various ways within different legal contexts.
